GENERAL TERMS of CONTRACT


    • All orders processed by ARTEX Art Services GmbH are exclusively subject to the following general terms of contract (in short: GTC) and the General Austrian Terms of Conditions for the Shipping Industry (in short: AÖSP); this also applies to orders by non-business clients.
    • The GTC also apply to contracts and orders even when they have not explicitly been agreed to. A reference to disclaimer and limitation of liability is contained in the AÖSP. These GTC apply to services of any kind connected with the handling of objects of fine art, like shipping, transporting, storing or other businesses belonging to the field of fine art.
    • Among these, for example, are installation or de-installation, crating and packaging, loading, unloading, customs processing, courier services and obtaining transport and object insurance.
    • At the time an order is placed, the client must inform ARTEX Art Services GmbH about addresses, number of packages, their nature and contents, and the weight, volume, condition and real value of the fine art objects.
    • ARTEX Art Services GmbH is only liable for damages caused by breach of due diligence. Liability covers explicitly only loss or damage of art objects that are subject to the contract.
    • Liability for damages of goods is limited to € 8,33 special drawing rights for each kilogram (gross weight) of the fine art object damaged or lost, according to CMR, if the object was transported on the road. It is € 16,67 for air transportation according to the Warsaw Treaty.
    • ARTEX Art Services GmbH will obtain insurance (transport and storage insurance) for art objects only if there exists an explicit agreement in writing, stating the amount insured and risks and dangers to be covered.
    • If damage to the art object is externally visible at the time of delivery, the recipient must document this fact on the receipt and have it signed by both parties. Also, the recipient has to report immediately, at the latest seven days after delivery, in writing, any damage that has not been detectable from the outside.
    • Invoices are payable on receipt without deductions. Default of payment commences without dunning at the latest 10 days after receipt of the invoice. In case of default, interest of 12% and usual bank expenses will be charged.
    • To all parties involved in the contract, Austrian law applies. As far as a client is a consumer according to the Consumer Protection Law, Vienna is the place of fulfillment and the exclusive place of jurisdiction for all disputes arising from the contractual relationship.
